These Terms of Service ("Terms") govern your access to and use of the ShipShape website https://shipshape.sh (the "Website") and the ShipShape product (the "Product"). By accessing or using the Website or Product, you agree to be bound by these Terms. If you do not agree, do not use the Website or Product.

ShipShape is operated by an individual acting as a sole operator ("we", "us", or "our").

ShipShape provides an application starter in the form of a GitHub repository template designed to help developers bootstrap web applications, including tooling and configuration for a modern development workflow.

ShipShape is a developer tool and does not provide hosting, runtime environments, or end-user application services.

You may use the Website and Product if you are at least 18 years old or have the legal capacity to enter into a binding agreement under applicable law.

Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Product for personal or commercial development purposes.

You may:

• Use the Product to build applications for yourself or third parties
• Modify the code as needed
• Use the Product in commercial projects

You may not:

• Misrepresent the Product as your own original work
• Remove copyright or license notices included in the Product
• Use the Product for unlawful purposes

The Product may include open-source components governed by their own licenses. Those licenses take precedence where applicable.

The ShipShape name, branding, Website content, and original code provided by ShipShape are protected by intellectual property laws.

No rights are granted except as expressly stated in these Terms.

The Website and Product are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Product will be error-free, secure, or suitable for your specific use case.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, data, or business opportunities, arising out of or related to your use of or inability to use the Website or Product.

Our total liability for any claim shall not exceed the amount you paid to us for the Product, if any.

The Product and Website may reference or link to third-party services, including GitHub and other tools. We are not responsible for third-party services, content, or practices.

Your use of third-party services is governed by their respective terms and policies.

ShipShape does not process or control data of end users of applications built using the Product. You are solely responsible for ensuring that applications you build comply with applicable laws, including data protection and privacy regulations.

We may suspend or terminate access to the Website or Product at any time if you violate these Terms or use the Product in a manner that could cause harm.

Sections that by their nature should survive termination shall survive, including intellectual property, disclaimers, and limitation of liability.

We may update these Terms from time to time. Changes will be effective when posted on this page. Continued use of the Website or Product after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws applicable in your country of residence, without regard to conflict of law principles.
